Introduction
Welcome to the Remote.It Website and Service. These Terms of Use constitute a legal agreement between you, an individual user or entity (“Customer,” “you,” or “your”), and remot3.it, Inc. (“Remote.It,” “we,” “our,” or “us”) governing your access to and use of the Remote.It website, software, APIs, applications, and related services (collectively, the “Service”).
Remote.It provides secure connectivity between customer-authorized users, applications, and devices. Remote.It does not operate customer equipment, inspect Customer Content, or assume responsibility for the operation, availability, or security of customer devices, networks, or applications.
By registering for, accessing, browsing, downloading, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use, our Privacy Policy, and, where applicable, our Data Processing Addendum.
If you do not agree to these Terms, you may not use the Service.
Definitions
For purposes of these Terms:
Customer means any individual or legal entity using the Service.
Customer Content means any information, files, applications, communications, or other data transmitted or made available by the Customer through the Service.
Developer Tools means Remote.It’s APIs, SDKs, GraphQL interfaces, command-line tools, MCP integrations, documentation, and related software.
Service means the Remote.It website, software, applications, APIs, infrastructure, and related services.
License to Use the Service
Subject to these Terms, Remote.It grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your internal business or personal use.
All intellectual property rights remain the exclusive property of Remote.It.
You may not:
- Reverse engineer, decompile, or modify the Service;
- Rent, lease, sublicense, or resell access to the Service;
- Circumvent authentication or security mechanisms;
- Copy or distribute any portion of the Service except as expressly permitted.
Access and Modifications
You are responsible for obtaining internet connectivity and paying any third-party charges necessary to access the Service.
If you access the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
Remote.It may modify, suspend, discontinue, or enhance any portion of the Service at any time. We may also modify pricing with reasonable advance notice.
By using the Service, you represent that you are of legal age to enter into these Terms. Users located within the European Economic Area must meet the minimum age requirements established under applicable law.
Customer Content
You retain all ownership rights in your Customer Content.
Remote.It provides secure connectivity and remote access services. Remote.It does not intentionally inspect, monitor, or retain Customer Content transmitted through the Service as part of normal platform operation, except where expressly authorized by the Customer as part of a customer support engagement or as otherwise required by law.
This includes, without limitation:
- SSH sessions
- Remote desktop sessions
- ScreenView session content
- Camera video streams
- Industrial control communications
- Application payloads
- Customer files
You are solely responsible for your Customer Content and for ensuring it complies with applicable law.
Remote.It receives only those limited rights necessary to provide, secure, maintain, and improve the Service.
Artificial Intelligence Features
Remote.It may offer optional artificial intelligence (“AI”) capabilities, including Model Context Protocol (MCP) integrations.
Use of AI-enabled features is entirely optional.
Remote.It:
- does not use Customer Content to train artificial intelligence models;
- does not transmit Customer Content to third-party AI providers unless expressly configured or initiated by the Customer;
- allows Customers to disable AI-enabled functionality.
AI-generated information may be incomplete or inaccurate. Customers remain responsible for validating any AI-generated information before relying upon it.
APIs and Developer Tools
Remote.It may provide Developer Tools to facilitate integration with the Service.
Customers agree to use Developer Tools only in accordance with published documentation and reasonable usage limitations.
Customers may not:
- interfere with platform stability;
- circumvent authentication;
- exceed documented rate limits;
- use Developer Tools in any manner intended to disrupt the Service.
Remote.It reserves the right to suspend Developer Tool access to protect platform security or reliability.
Customer Authorization
You represent that you have the legal authority to register, access, and manage every device, service, and endpoint associated with your account.
Remote.It personnel may access customer environments only when expressly authorized by the Customer to provide requested technical support.
Support personnel are procedurally prohibited from initiating customer access sessions outside authorized support activities.
Account Security
You are responsible for maintaining the confidentiality of your account credentials. Remote.It is not liable for unauthorized use of your account. Notify us immediately if you believe your account has been compromised.
ScreenView
ScreenView enables secure remote viewing and interaction between authorized users and customer devices.
Remote.It does not record or retain ScreenView session content as part of normal platform operation.
Customers remain responsible for complying with all applicable laws regarding remote monitoring and user notification.
Acceptable Use
You agree not to use the Service to:
- violate applicable laws;
- transmit malicious software;
- conduct phishing or credential theft;
- perform unauthorized surveillance;
- interfere with Service availability;
- conduct denial-of-service attacks;
- engage in unauthorized cryptocurrency mining;
- violate export control or sanctions laws;
- collect personal information without authorization;
- attempt unauthorized access to devices, accounts, or networks.
Remote.It reserves the right to suspend or terminate accounts engaged in activities that threaten the security, integrity, or availability of the Service.
You further agree to abide by our Fair Use Policy.
Subscription Plans and Billing
Remote.It offers free, subscription-based, usage-based, and enterprise licensing options.
By subscribing to a paid plan, you authorize recurring charges using your designated payment method.
You agree to maintain current billing information.
Except where required by law or provided in a separate written agreement, subscription fees are non-refundable.
Remote.It may suspend or terminate Services for non-payment following reasonable notice.
Termination
Remote.It may suspend or terminate your access at any time, with or without cause or notice. You may cancel your use of the Service at any time unless governed by a separate written agreement.
Data Protection and Privacy
Remote.It processes personal information as described in our Privacy Policy. Business customers requiring a GDPR data processing agreement are covered by our Data Processing Addendum. Users located in the European Economic Area and the United Kingdom retain all rights afforded to them under the GDPR and UK GDPR.
Third-Party Content
We are not responsible for third-party content, links, or websites. Use of such content is at your own risk.
Business Transfers
If Remote.It undergoes a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, these Terms and associated customer agreements may be assigned or transferred as part of that transaction.
Any successor organization will remain bound by these Terms until updated Terms are published.
Force Majeure
Remote.It shall not be liable for delays or failures resulting from causes beyond its reasonable control, including natural disasters, acts of God, war, terrorism, civil unrest, labor disputes, internet outages, cloud infrastructure failures, utility failures, governmental actions, epidemics, pandemics, or failures of third-party service providers.
Remote.It will use commercially reasonable efforts to restore the Service as soon as practicable following such an event.
Warranty Disclaimer
The Service is provided “AS IS” and “AS AVAILABLE.”
Remote.It disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Remote.It does not warrant uninterrupted availability of the Service.
Limitation of Liability
Remote.It’s total liability shall not exceed $100. The liability cap does not apply to: (a) data protection violations under GDPR, (b) gross negligence or willful misconduct, (c) Business plan users (cap at annual fees paid), (d) indemnification obligations.
Indemnification
You agree to indemnify Remote.It against claims arising from your use of the Service, except where prohibited by law, including GDPR protections.
Governing Law
These Terms are governed by the laws of California, with jurisdiction in Santa Clara County courts. Any conflicting provisions shall be overridden by your local rights under GDPR or applicable data protection laws.
Updates to These Terms
We may update these Terms at any time. Changes will be posted at https://remote.it/legal. Continued use of the Service constitutes acceptance.
Language
These Terms are written in English. Translations may be provided for convenience, but the English version shall prevail.
